摘 要
通過對馬克思主義關于跨越式發展理論的經典整理和研究，首先總結出跨越式發展的哲學內涵。中國以馬克思主義跨越式發展理論為指導，在實現了社會形態跨越式轉變之后建立了社會主義國家；為了更好地提高社會生產力，體現社會主義制度的優越性，我國也實行了生產上的跨越式發展。但是由于這種發展方式實行的是超常規的發展，和其所特有的發展的不均衡性等原因，由此而產生出政治、經濟、文化、法治等方面的諸多問題。根據馬克思主義法學的理論，可以通過法律對經濟基礎的能動的反作用來實現促進生產力發展，推動社會的進步。本課題從法在跨越式發展中的地位和作用入手，來探討跨越式發展當中由于超常發展而出現的諸如：行政治理能力問題、腐敗、環境污染、貧富差距、超常規發展和不平衡發展中的社會不公、盲目的發展導致項目缺乏合理性、問責機制不完善等方面的問題，分析以上問題，向跨越式發展提出一個動態的發展框架，用法律手段給跨越式發展提供其所需的資源、權力，并用法治引導跨越式發展趨向平衡的發展，通過法治建立救濟機制以減少由于跨越式發展給人們帶來的傷害。通過對立法、司法、執法的完善、搭建起職業的法律群體、加強社會法治文化、建立多渠道互通和聯合的監督機制體等手段，盡可能的實現跨越式發展科學、全面的發展。

ABSTRACT
Based on collation and research of Marxism in leaping development theory of classical,firstly summed up across the philosophical connotation of the development, China had takenleaping development theory of Marxism as a guide, in realizing rapid transformation of thesociety established a socialist state, in order to better improve social productivity, reflectingthe superiority of the socialist system, our country has also implemented the productiondevelopment by leaps and bounds. However, due to the implementation of this development isthe ultra conventional development, unbalanced reason and characteristic of its development,resulting in a many problems in the aspects of politics, economy, culture, law, etc Accordingto the theory of Marx's theory, we can realize the economic basis of law to achieve theeconomic basis of the role of the initiative to promote the development of productive forces,and promote social progress. This topic from the law angle across the status and role ofdevelopment, to explore the leap forward development and extraordinary development suchas: administrative governance problems, corruption, environmental pollution, the gap betweenrich and poor, supernormal development and unbalanced development of social injustice,blind development leads to the lack of rationality, ask the project accountability mechanism isnot perfect, analyzing the above problems, proposed the development of a dynamicframework to leapfrog development, using legal means to provide the necessary resources, thepower of the great leap forward development, and the rule of law to guide the development ofleap forward development trend balanced, through the rule of law to establish a reliefmechanism to reduce the leapfrog development bring damage. Through the legislative,judicial, the perfection of law enforcement, to build up professional legal group, strengthenthe social culture of the rule of law, the establishment of multi channel sharing and jointsupervision mechanism and other means, as far as possible to achieve across the developmentof scientific and comprehensive development.
